Lack of pedal change in AI on the 2nd beat of bar 36 and 38 is an earlier version, completed by Chopin in A and repeated in this form in the remaining sources. Similarly in bars 40-41. In the entire final part of the Etude, in the final version, Chopin opted for rather more frequent pedal changes.
